(Edited) Not in our view. Pestell didn't publicly intervene, but reading the letter & lawsuit - he very likely tried to intervene but couldn't override CEO.

And that is probably where all the tension and later explosion comes from.
CEO couldn't bear his CMO any longer, as Pestell didn't agree with his leadership risking the whole cancer operations.

EDIT: And do not forget, Pestell had serious negotiations ongoing. This is supported by stating that Goldman Sachs was involved.
