The court has not ruled on Hubai's attorney's most recent request to file a motion for summary judgment. It was referred to the Magistrate handling the case for a decision. If she allows them to make a motion the Court will set a briefing schedule for both sides to submit papers.

There is a telphone conference with the magistrate on 8/26 at 12:30 to discuss the status of discovery.
