In this related CFPB case an AMICUS CURIAE BRIEF was filed in the 5th circuit on July, 31st asking to find CFPB structure unconstitutional.

The ruling in this case could bear on our case and it's timing.

If the 5th circuit is waiting on the Supreme Writ regarding separation of powers question, I do not know, but it wouldn't surprise me.
