The process you describe can't happen unless the case is sent back to the lower District Court. Appeals Courts don't look at the evidence. Their only job is to decide whether District Courts followed the legal process correctly, using the principles in the U.S. Constitution.

To be specific, Greenshift is asking the D.C. Appeals Court to decide whether the District Court made any legal errors when they decided the case against Greenshift. Nobody and Slash have said that they think that the original (deceased) District Court Judge did make some legal errors and that if those errors had not been made, the case would've been decided in favor of Greenshift.
