1. if the issue of FHFA constitutional or not was key --- when the GOV agreed they were structured in a non constitutional fashion --- I could then see where that day it would take 5 minutes to say - so since the FHFA is not constitutional its action are "stopped" - NWS is killed

2. If the issue of constitutional or not ---- is not key ----- how is a decision - that is different from the panel or 10 other cases - made in our favor in 5 minutes ? Or is the 5 minutes a negative decision based on the anti judicial review clause in HERA?

The answers to the above questions asked must be given by the author of the sentences given.
