So there was capacity in place to sell more processors.

Maybe, maybe not. IBM has had terrible yield problems over the years and AMD's process is closely related. You can bet that Intel will demand yield reports in the lawsuit for the purpose of (possibly) showing AMD couldn't deliver more if they wanted to.
