It seems pretty clear it was a statement of fact. So looks like SEC violation?

Why I face no sanctions is simple. I produce facts. Why the company will face sanctions is the fictional press releases. Even the Safe Harbor disclosure cannot protect them now after the PVC deal. But, is it important enough for the SEC to do anything about it given the massive fraud discovered elsewhere? Who knows. There are bigger fish to fry than Chris Jensen and Rick Wilson. That's a fact. It's the bigger fish behind them that they want. And, that will take much more than ICBU and EXMT to take those guys down. To those guys, this is no different than a vending machine laundering operation. Throws a few bucks in the coffers and has little risk while providing toxic financing to all these little guys... and that's where their money is made. Easy to flush a few while banking 10 steps ahead.
