PLAINTIFF’S REPLY IN SUPPORT OF MOTION FOR JUDGMENT
SETTING AMOUNT OF DISGORGEMENT AND CIVIL PENALTIES
Plaintiff U.S. Securities and Exchange Commission (“SEC” or “Plaintiff”) submits this reply in support of its Motion for Entry of Final Judgment Setting Amount of Disgorgement, Prejudgment Interest, and Civil Penalties to be Paid by Defendant Andrew J. Kandalepas (“Motion”). (Dkt. No. 45)
In a minute entry entered on April 15, 2019 (Dkt. No. 48), the Court set a briefing schedule on the SEC’s Motion. Defendant’s Response was due by May 6, 2019. Defendant has confirmed to counsel for the SEC that he did not file a response.
For all of the reasons stated in Plaintiff’s Memorandum in Support of Motion For Judgment Setting Amount of Disgorgement and Civil Penalties and Exhibits (Dkt. No. 46), Plaintiff U.S. Securities and Exchange Commission respectfully requests that the Court issue a judgment ordering Defendant Andrew J. Kandalepas to pay $593,363.25 in disgorgement, $113,554.63 in prejudgment interest, and appropriate civil penalties.
