Moving party failed to file the moving papers 16 court days prior to the date of hearing. (Code Civ. Proc. § 1005(b) (“Unless otherwise ordered or specifically provided by law, all moving and supporting papers shall be served and filedat least 16 court daysbefore the hearing.”) (emphasis added); California Rule of Court 3.1300(a) ("Unless otherwise ordered or specifically provided by law, all moving and supporting papers must be served and filed in accordance with Code of Civil Procedure section 1005") (emphasis added).) Here, moving party filed the motion on May 2, 2019, for a hearing date of May 17, 2019. The moving papers were therefore not timely filed. The Court requires the statutory time period to properly review the case. The minute order is effective immediately. No formal order pursuant to CRC Rule 3.1312 or further notice is required.
