I agree and disagree with you at the same time.

I am aware that the 2018 Farm Bill explicitly preserved FDA’s authority to regulate products containing cannabis or cannabis-derived compounds under the FD&C Act and section 351 of the Public Health Service Act (PHS Act). FDA treats products containing cannabis or cannabis-derived compounds as it does any other FDA-regulated products.

With that being said, the FDA considers the selling of marijuana as illegal yet is aware that several states have either passed laws that remove state restrictions on the medical use of cannabis and its derivatives or are considering doing so. They are welcoming communications with the state and local governments but have thus far been reluctant to do more then serve warning letters to companies that operate in those states.

When a product is in violation of the FD&C Act, FDA considers many factors in deciding whether or not to initiate an enforcement action. Those factors include, among other things, agency resources and the threat to the public health. FDA also may consult with its federal and state partners in making decisions about whether to initiate a federal enforcement action.

So the sale of a product may be deemed illegal at the federal level but legal at the state level.

I have not seen proof that VitaminFIZZ is in production nor am I saying that the pathway to selling CBD infused water is an easy one. I will say that it is possible, whether or not it is considered legal at a federal level.
