2019 Financial Statement Staleness Date

As financial statements are considered “stale” when they are too old to be used in a prospectus or proxy statement an issuer must file the most recent required financial statements before using a prospectus or proxy statement.

As Delcath missed the 10-K they can no longer use the S-3 shelf registration that was in place (from my understanding of what I have read) and they must issue their year end 2018 financial statement on May 14, 2019 or 134 days after fiscal year end to stay in the game.

So my question is, does anyone expect to see this filing by the end of the business day?
