Yeah, I found that to be tricky too, but he never explicitly says he subscribed. It would probably come down to whose lawyers were better. Unfortunately, good lawyers aren't cheap which makes the probability of success much less than 100%. I've already taken a bath on the stock and can't afford to keep digging.
