If the lawsuit is successful there is nothing but upside, lawsuits don’t move quickly they take time and effort and this suit is getting all of that. So if you don’t have the patience to see it through might as well take your loss and move on, although it seems to me if you waited this long you might as well hang on and see how it plays out, risk reward clearly in your favor, imho!!!!
