Well, technically, they don't HAVE to do anything. This is because they are a Pink Sheet company. This is why institutional and other serious investors tend to stay away from them. This is why it will be challenging for them to get real corporate contracts. This is also why... they have repeatedly expressed intent to uplist.

But, if they really want to uplist, they have to follow conventional exchange SEC regs like... filing audited fins on-time.

And, my guess is that to follow regs, they'd have to file the extension prior to the deadline expiry. Not sure, but this would make sense.
