When you are negotiating multi million dollar deals with public companies, you don't disclose who the parties are until the deal closes for about 10 different reasons. Discover loans money to lots of small biotechs- this is different because they were weeks away from selling assets that are worth millions so Kirkland wanted to cash in and try to take over-most of the loans he makes are to small bs companies years away from monetizing anything. usually these lenders would never want the asssets because they cant sell them. this was different- they had offers and Kirkland got greedy. They are selling Ceplene first because they have to close by March 31st to avoid Discover securing on it. Also they had the offer come in November and already had a deal to sell it. Bert was still in negotiations when they filed for the trustees sale.
