I spoke with SEC ombudsman Tracey McNeil today.

I called about another scam, but we talked for almost an hour and I brought up many things including the rampant fraud in the OTC and the SEC's apparent inaction to the Marani complaints.

She doesn't remember talking to anyone about Marani, but she talks to a lot of investors and may have forgotten about those calls. Did you perhaps speak to a previous ombudsman?

I asked if she could look into why so many complaints have reportedly been filed, yet no charges have been filed and asked if she could perhaps push the case ahead in line.

She did say the same thing I've been saying - that they're understaffed and there are far too many "bad guys" for them to chase. But she'll see what she can do.

She suggested I use their TCR form (website https://www.sec.gov/tcr) to send information directly to the enforcement dept.

"Remember to provide your contact information, state that you are a harmed investor, and state the name of the case."

The website says it's for whistleblowers, but the form itself says it's for tips, complaints or referrals.

I'm not convinced it goes anywhere special that the regular complaint form doesn't.
So far it looks like all the complaints went straight into the round filing cabinet. frown

She sent me an email which includes this standard message:

Please note that it is the Commission’s policy to conduct its investigations on a non-public basis in order to preserve the integrity of its investigative process, as well as to protect persons against whom unfounded charges may be made or against whom the Commission decides not to bring an enforcement action. Subject to the provisions of the Freedom of Information Act, staff cannot disclose to you any information which we may gather, nor can we confirm the existence or non-existence of an investigation, unless such information is made a matter of public record in proceedings brought before the Commission or in the courts. You can find information about public enforcement actions on our web site at http://www.sec.gov/litigation.shtml. Otherwise, Division of Enforcement staff are unable to report to you whether any action has or will be taken with respect to the issues you have raised.
