The O/S is what it is as of January 31. It doesn't matter when the quarter ended. He posted the new O/S to the OTC with the share reduction in February and IT WAS THE WRONG O/S no matter when the quarter ended or how you slice it. Call it what you want but I don't believe for one second that Steve didn't know what the true O/S was when he updated the OTC. Did we forget about all the delays because of the back and forth between Steve and the t/a? Steve knew what the real O/S was when he updated it on the OTC. Not doubt. And whether or not he did this legally isn't really the point. He tried to hide the fact that dilution was taking place.
