- On February 7, 2019, an Application for the Appointment of Custodian Pursuant to NRS 78.347(1)(b) was filed by Petitioner Joseph Arcaro. The matter was subsequently placed on Department XXXI's March 12, 2019, motion calendar. No opposition being filed and the time for opposing being past, the motion is ADVANCED to today's date pursuant to EDCR 2.23. Accordingly, the March 12, 2019, hearing is VACATED. As no opposition has been filed, the COURT FINDS that the motion is appropriately GRANTED pursuant to EDCR 2.20. Additionally, based on a full review of the pending motion it is also GRANTED on the merits pursuant to NRS 78.347 and Petitioner having satisfied the statutory requirements. This Decision sets forth the Court's intended disposition on the subject but anticipates further Order of the Court to make such disposition effective as an Order or Judgment. Such Order should set forth a synopsis of the supporting reasons proffered to the Court in briefing and argument. Counsel for Petitioner Joseph Arcaro is directed to prepare the Order, and submit it to Chambers within 10 days pursuant to EDCR 7.21.
