For someone to say that a bk judge would approval picking the pockets of thousands of investors to bail out a mismanaged and bloated company is insane. No judge would say "ok hedge fund, you screwed up. I'll let you not pay your creditors AND steal over 100mil from retail investors as well as 401ks and institutions that have believed in SEARS for the last 50 year's" total b.s.
