Elmer: Re: I don't recall a compaq case...

It occurred about the same time as the first Intergraph case:

...but in the case of Digital let me ask you, what would you do if you were sued in another companies home state?

If I though I were right, I would fight it until the bitter end, particularly if I had the legal resources that Intel has.

Remember that Intel counter sued Digital and one could just as easily say that Digital settled.

Intel counter-sued Intergraph too. Interestingly, Intel was unconcerned about the alleged egregious infractions until they were named in each suit. Also, interestingly, the FTC never filed charges against Digital of Inbtergraph, whereas they did against Intel.

The cost was $500million. Who took who to the cleaners?

The settlement amount was undisclosed, but I have seen estimtes as high as 1.6 billion.

As for Intergraph, that case is still in the courts...

No, it's not. There are two cases involving Intergraph. Intel settled the first one for $300,000,000.00. The second one has yet to be decided.

...any money Intel pays to settle that case is like paying an insurance premium against an ignorant jury.

Perhaps. It could also be a tacit admission of guilt, particularly since an FTC panel had a preliminary finding of unfair practices.

You can spin a huge settlement any way you wish. That is really up to you. However, you make yourself look a bit ridiculous when you compare assertations of Intel unfair trade practices to alien sightings and such. There *is* evidence. A large body of it. Is there conclusive proof that it is happening now? No. However, when you ridicule people for concluding that it might *still* be going on, you bring yourself and the quality of this board down several notches. It is not outside the realm of believeability when vendors offer first-hand statements even to tabloids like the Inquirer.
