That isn't how the law works. The original verdict in his case was reversed on a technicality. I suggest you read the relevant documents. This is what the Ninth Circuit ruled:

Note that their decision has nothing to do with innocence or guilt. The ruling was based, as are nearly all appellate rulings, on judicial error.
