A thought, ATIV gave Bungie a major game once they take ownership and start selling they will be infringing unless they take license.
Two points:
1.by licensing they will be recognizing the legitimate WDDD licensing claim.
2. If they do pay a licensing fee that fee could become the floor for WDDD in charging licencing fees, that same price will establish for the courts a historic basis for licenceing fees in the judge's instruction to the jury to assist in the jury's determining $ damages for licensing portion.
