Banks / financial institutions can lose their charter. Grow big or die is the only options available as long has fed status remains.

I wouldn't necessarily call not pursuing Canada a mistake, it was a calculated move and like you mentioned, who knew it would still be illegal in the States, particularly Banking. If that issue would have been taken care of, not listing in Canada would have been a genius level move.
