He responds every time I reach out. I am sure he will to anyone who tries. This was the update that I received today:

"Our pre-motion conference for our Motion to Dismiss is 2/27.
We continue to work with our JV partners to finalize the structure of the ventures and bring in the funding. We should be able to announce something shortly."

I am sure that on the advice of counsel, he can not elaborate further.
