I was fortunate to be a part of the very first RICO statute prosecution in history in the northern district of NY a few years back now. The case was against a medium level organized street gang that fully deserved the indictment. I will say the current crime probably does fit the statute but I will also say that selective prosecution is alive and well. I would be hard pressed to believe this “grand” statute would be willingly prosecuted. It’s unfortunate but I just don’t see that happening.
