In an effort to try and understand the whole dynamics of the term ‘claim construction hearing’ I did a quick study online about the issue. What I’ve determined is that it seems there is at least enough merit to this case that the judge has deemed it worthy to be heard by the court and to advance the case to the claim construction hearing or another term for this type hearing is also called a Markman hearing...I believe the upside to the case is that it has not been dismissed for being a frivolous claim or having zero merit...now of course AVOI will need to present a solid blueprint of their actual patent grievances that at the hearing must be acknowledged by the judge to be favorable to the plaintiffs in order to set the course for a trial by jury. It seems often that it may be settled before trial by a defendant in the event the plaintiffs are given the favorable outcome and as defendants they do not prevail at the Markman hearing...I think the upside to AVOI prevailing in this case is well worth the risk despite the fact that Apple is one of the most powerful and wealthiest entities in the world. A few hours on the Internet shows that Apple has definitely lost a number of these type patent infringement cases but it is evident they have also prevailed in a number of similar patent infringement cases as well. As for myself I’m staying in it for sure...the upside is very alluring and I can hold for the verdict.
