"Both companies have filed their Q3 earnings as new evidence. Clearly this is to show that Tercica needs the $10 per month royalty and Insmed is not making that much.

Both companies have agreed to pare down the suit; both conceding on some claims and reserving the right to appeal. The new streamlined trial should be shortened.

Jury was selected yesterday.

Despite the appearance that they could not come to a deal on this thing, as some have contended, I believe they have. It looks to me like they have agreed on a settlement of parts subject to the jury decision on the remaining few points. This may not go much into next week."
