This is Rik’s response just now to my email this morning asking for an update

“Sam,

We're still working with our JV partners to try to close it up in February. Once they give us the "thumbs up", we'll put out a new press release as an update.

We've filed a letter Motion to Dismiss with the judge in the SEC lawsuit. The next step will be a pre-motion conference to discuss our full Motion to Dismiss. We believe that the suit is without merit and will continue to mount our best defense. I've attached the letter Motion for your reference as this is a public document.
