It appears to me that a Mr. Ludwig was one of the creditors listed on the " unclaimed funds " list in the bankruptcy docs and has now retained a " funds locator " to try and collect the $1,568.36 that he was owed and remains unclaimed . I am no lawyer by any means and don't know the legalities or time frames that determine how long a creditor has to try to collect these unclaimed funds . The Trustee has taken the money left over from these unclaimed funds and deposited it with the Clerk of the U.S Bankruptcy Court in order to have the bankruptcy case closed so I would think that by doing so it would relieve them ( ASFX ) of any liabilities and should have no effect on them moving forward.
That is how I understand it anyway and could be wrong. I have no idea what happens with these funds once the bankruptcy case is closed but I would think that any effort to collect these funds by any of the creditors would be between the creditor and the Clerk of the Bankruptcy Court and not the company itself . I am curious as to why they would have waited until three months has passed since the case was closed to try to collect these funds and if it was indeed an attempt to be some sort of a stall tactic for some unknown reason but as I said before I don't believe it would have any effect on what this company does moving forward since it is no longer in their bank account. JMO .
