Not sure anyone can do anything. They may not have done anything illegal. Just unethical.

Like they could offer a store a free display with a few dozen popsycakes for free to let them try them out, see how they sell there.
Then they can tweet and Facebook that their product is now sold in Such and Such store.
Now the store may sell some, eat some themself, and never intend on actually buying any to restock the display... But it was accurate to say they are being sold there. Then everyone thinks we have a new client that will be ordering product.

IMO, that is what they do here.... People WANT to believe things so they do. lol

Hell, it has been over 10 years they talked about selling frozen Pizza. We have never had any made. But after 10 Years... It was announced "Frozen Pizza Ready" It was ready because they found a manufacturer that would be willing to make and package the Pizza.
Over a year later, we never once placed an order to actually have any made, because we have no stores that will sell them. But the statement "Frozen Pizza Ready" may be true in the fact that they can now order some. We have no details on how many need ordered at a time, where they would go, etc... But people want to think we will be in stores everywhere and their Triple Zero will turn into the next 1.00 stock.
In reality, we have never had frozen pizza made, have no sales rep that goes to stores, no in store sample people where you can do that, etc.

They bought popsycakes for I think 2k and a load of stock. Look at the miles they got out of doing that. PR's for years, Talk of being in Dunkin donuts, donut connection, and all other places. It was all talk. No donut shop is going to buy premade stuff and sell it when they make stuff fresh all day for way less. But people don't think about it much, they WANT to think we will be selling all over the country in every Donut Connection and Dunkin Donuts. All they have to say is we talked to Someone with Dunkin Donuts about selling Popsycakes There.
In reality, Jim could have stopped in to buy donuts, saw a manager working, told him or her about popsycakes and gave them a dozen to try.
Even though nothing is expected to come of it, the Statement "We were talking to Management at Dunkin Donuts" is accurate. LOL

Its all what you want to believe.... This company has survived for 13 years by selling stock. When they run out, they do a RS and get the stock back. Lay low for a while, people move on, write off their losses, etc. Then soon they will be "Talking to Someone about Acquiring something, etc to get things going again.

Another Example... "We secured Million Dollars financing for Pizza Franchises.
In reality, they may have talked to someone who offered to finance the right people if they have a huge downpayment and excellent credit with assets to back the loan.
In reality, No one that could meet the conditions to get financed would be dumb enough to buy a franchise in a pizza company that has NO PIZZA SHOPS, no franchises, and has not operated a pizza shop in over a decade! lol But yea, we will pay you 100K for the right to use the name Unique and rely on their experience and buying power, marketing prowess, then pay you monthly royalties... lol, No one is ever going to buy a Unique Pizza Franchise! lol But again, people WANT to believe it.

I am not so sure any of that is Illegal, maybe considered "Forward Looking Statements"
