I would see the C E issue as bungie wished for the following:
STOP WDDD from retrying the issue i beleive of the 3 IPRS left out
Stop WDDD from retrying the issues of facts - based on the issue where for some reason we did not appeal the issue of discovery (to the same people that just denied it back then).
Stop WDDD from getting to the RPI issue by means of WDDD should not be allowed due to move forward because of the above and because all original IPRS were basically a cut and paste (same language used) IN ALL 6, THEN if three were found unpatentable then all must be found unappealable - DATA could most likely speak tot his better. But i think i am close.

The PTAB has to be put in its place, this is BS.
