In theory I think the rules would be that the MM would be required to give you at least the threshold size of shares that he had to put up. Meaning if there is an 10k ask on a 8 cents stock and you hit it he would need to give you at least 10k before removing himself from the ask. That I think is technically the rule for an MM. But I have seen cases where they give you 5k and move up which is not ok but where is a judge right?
