This was the first part of Slash's message, which he posted on September 23rd in his message #47399. This is what I'm replying to in this message.

Skunk's October 3rd blog post quotes part of the Appellee's motion.

Appellees move for a forty-day extension of time, until November 19, 2018, to file their response brief. CrossAppellant Adkins Energy LLC also seeks a forty-day extension of time, until November 19, 2018, to file its cross-appeal brief. Appellants oppose any extension longer than twenty-four days.


That same message on Skunk's excellent blog also says this.

Upon consideration thereof, IT IS ORDERED THAT: The motion is granted. Appellees’ response brief and Cross-Appellant’s cross-appeal brief are due no later than November 19, 2018.


I'm going to put that last sentence from the court order in boldfacing, just to emphasize it.

"Appellees’ response brief and Cross-Appellant’s cross-appeal brief are due no later than November 19, 2018."

November 19th is this coming Monday. If the Appellees have filed their response and their cross-appeal brief early, Skunk hasn't posted them yet. He usually posts court information the same day it happens, so I think the response and the cross-appeal brief haven't been filed yet.

In other words, I think the Appellees are waiting until the last few days, maybe even the very last day out of the 40 days that the judge granted them, to file their response and the brief.

If they miss the deadline, the GERS stockholders will find out soon enough what that will mean to the price of the stock. IMHO, it could give us all a nice rally.

If, however, the Appellees file something before the deadline, at least we will get something meaningful to talk about early next week, maybe sooner.
