It's not (a legally acceptable method for registering votes).
I have had calls in the past soliciting my proxy in cases where they needed a quorum but didn't have one.

A speculation:
The votes may have been coming in slowly enough to make some calls or to hire a solicitor. They can't take an actual vote over the phone but they can solicit and perhaps record a commitment as proof of their effort. They have been known to keep calling until the holder submits their proxy.

"The approval of the Company’s Equity Incentive Plan (Proposal 2), the award of warrants to Dr. Seymour (Proposal 3) and the award of shares of Series A Convertible Preferred Stock to Dr. Anil Diwan (Proposal 4) require the affirmative vote of a majority of the Company’s outstanding common stock present at the Annual Meeting, broker non-votes and abstentions will not count as affirmative votes."
