But, let's look at another scenario.
MNTA and Novartis split the bond at 1 to 5... I would think they split the damages the same ratio should they lose the anti-trust case. Being the smaller company, Mnta's exposure is much less, imo.
However, if they win the patent infringement appeal case... it stands to reason that they will also split the $1 Billion (or treble that amount- $3 Billion$!) the same ratio*. Also they would get their $100 million bond back too.
* This could go 50/50 since they've agreed to split the profit in half before they took gEnox off market.
Amphastar and Momenta both have swords in their hands. And judging from William Peters' remark they are willing to settle out of court.
Mnta/Nvs team's reaction will be a telltale sign on how strong their patent infringement case is. Seize this opportunity to settle or say nothing and forge ahead... which means they have the stronger case... imo.
