He had to disclose that the SISP was not successful and the company was moving to liquidation. There was no choice. BIOAQ is a publicly traded stock and that was VERY material information.
The stock tanked because most “investors” understood at that moment that the stock was essentially worthless, there would be no recovery to the common shareholders. So it essentially gapped down 80% on volume approaching the OS.
The only ones buying it after that were flippers and those not willing to accept the reality and were “averaging down”.
