my layperson's understanding is, based on the prior cases, being allowed to file a motion isn't signficant (ie that doesn't mean it is granted), but rather seeing what the judge decides after reviewing the motion and the response to the motion. In the prior cases, ie AirClic, the defendant AirClic also filed motions and none of them were decided favorably by the judge.
But, clawmann, I defer to your expertise here.
