TREP v. IRS


TREP is the plaintiff in this case. IRS is the defendant.

5 different actions were by TREP against the IRS. It appears that the IRS filed liens against TREP for payroll tax liabilities from the year 2011-2013.

TREP says that the IRS failed to comply with the Freedom of Information Act.

TREP wanted a complete copy of the administrative file for TREP from the year 2007-2014.

Basically TREP is saying that hey you want to file liens against us for payroll tax liability then we need all the information in your hands to properly assess the situation.

They are entitled to the “info” under the Freedom of Information Act.

The FOIA requested by TREP was granted and denied in part.

TREP had over 20 related entities. Which means they have deep pockets!

There were 65 boxes of documents and over 141,000 pages that had TREP name on it in the records. The IRS doesn’t want to disclose records to TREP with 3rd party names on it.

So MSJ won by IRS.

TREP is fighting with the IRS, They have money to do that.
