I believe that the judge has given himself the hoe on the feet, in the sense that he recognized the bad faith of the defendants on the non-respect of contracts. In fact, the existing contract concerned the delivery of a precise and advanced technology for commercial, military or other purposes. Basically it seems obvious that the owner of the technology handed over to the defendants was SECI, the fraud, the non-compliance with the contract is only a consequence of the theft or rather, copying of the software. I believe that the judge alone has felt too much responsibility for a SECI victory across the board, therefore with the sentence sent back the final resolution of the matter through a public trial, complete with a jury, which will easily agree on the allegations of Seci and issue the right millionaire reimbursement!
