The source of the CBD matters. Imported-Hemp-derived CBD sourced from the sticks, stems, and seeds is already not a controlled substance, which is why you don't see the DEA kicking down CVSI's doors. Epidiolex is not pure CBD; it contains ethanol, CBD, flavoring, etc --which is why it was patentable, because isolates and extracts are not patentable by themselves; however, the CBD in Epidiolex is 98% pure --derived from marijuana --not hemp. Marijuana is controlled. Imported hemp products that are derived from the sticks, stems, and seeds are not considered controlled substances and are 100% Federally legal right now. This means that the FB should not hold up a NASDAQ uplisting. See here for more information.

FDA wants CBD completely descheduled, but DEA cites treaties

BTW, the FDA wants CBD completely descheduled, but international treaties are the only things holding it up. The FDA stated in an April briefing on CBD that "CBD has negligible abuse potential," so I think it's safe to say that those international treaties will change sooner rather than later.

It took me days of research to find these answers. Although the Farm Bill would certainly clear much of the ambiguity, I assure you that CVSI's product is federally legal right now. Does anyone here think they would be shipping to all 50 states if it wasn't? C'mon now..
