No, they didn't. Again, that is an incorrect reading of the actual legal documents.

The actual phrase is "in the best interests of the Company, their creditors, and other stakeholders.". Other does not equal all. In this case, the other is the employees and the local government, who benefits from an operating plant.

Nowhere is common shareholders either mentioned or even implied. If they had meant common shareholders, they would have said "common shareholders", just like they said creditors.
