Right! So industrial hemp is required to have a THC content of less than 0.3%. The question is then what is the THC content of CBD oil, which is a product of extraction from industrial hemp? Is it less than 0.1%? The FDA seems to be still holding the ball. This article also has some interesting commentary on this topic - it is very conflicting, both good and not so good - "muddy" is the term. FDA Enforcement following GW Drug Approval?
