It will be used when it matters. Next Q-report stating that "no cash for dividend at this time" will be that time.
They don't need to promote the damages.
Everything about this company is totally unbelievable so why bother building something that can have some negative impact on their share selling operation in the meanwhile.

You have a point but you would expect a whole PR page of damages of something worth in excess of $300M to have cost more than just $1M.
