Hoghead7 here is an article addressing the lawsuit filed by FCEL involving the state of Delaware and Bloom. FCEL was victorious reaching a settlement and FCEL was awarded $45,000 to cover their legal fees.

In 2012, FuelCell filed a lawsuit arguing the financial incentives were only offered to Bloom without any public notice or competitive bidding.

The Heritage piece is all about Bloom, with John Nichols, a panel member and Delaware ratepayer who happens to be the individual that joined FCEL's lawsuit. He states in the youtube video "without the Delaware subsidy (at the cost to ratepayers) Bloom would not exist today."
