What if they win the lawsuit? Then you will lose out on the judgment. NO? Am I missing something? Why sell at today's prices and buy back in? The bid ask is close as I recall. I did not look at pps today yet. You can always take the tax loss in late December if needed. You can take the loss anytime on any tax year (2018 and forward)until this play ends.
