Intuitive Sues for Patent Royalties on Robotic Surgical System

(Bloomberg) -- Intuitive Surgical said Auris Surgical Robotics’ Monarch endoscopy platform infringes eight patents related to Intuitive’s da Vinci System and will compete with a forthcoming flexible surgical robotic platform.
Intuitive is seeking royalties and a court order blocking sales of Monarch or awarding royalties to compensate for future infringement, according to complaint filed Aug. 31 in federal court in Wilmington, Delaware
FDA in March approved Auris’s Monarch endoscopy platform for use under a doctor’s control in human lungs; Auris calls Monarch a "platform technology" that "will do other robotic endoscopies," according to complaint
"Auris has competed unfairly and unlawfully by infringing Intuitive’s intellectual property to create competing, unlicensed products," complaint says
The da Vinci system had $910.2 million in sales in 2017, 29.1% of revenue, according to data compiled by Bloomberg; the system sells for between $500,000 and $2.5 million, Intuitive said July 20 in its quarterly earnings report
Intuitive has invested more than $1 billion in research and development leading to the inventions at issue in this suit, complaint says
