Illegal and enforced are different. The laws are the same; the enforcement tends to be lacking, sure.

However, regardless of what they might be able to get away with if no one is looking, a major company won't risk it while going through a legal proceeding like this. And any (non-liquidating bidders) will be major companies with competent legal departments.
