"My take (please note I am NOT a lawyer), is that it is a tough call.
Basille lays out a great case for dismissal, and has the current court trend to support Usury statutes in our favor.
But LG puts up a strong response and has a case to which they were a party which they won in almost identical circumstances.
Basille's reply was strong and I think it is really up to the judge.
When there are good arguments on both sides usually the solution lies somewhere in the middle.
My guess is payment/settlement of outstanding principal or some combo of stock and payment to keep everyone happy. IT can really go either way. "
** So pretty much the same result as I thought, though this is not over yet. The motion to dismiss did not make it but the case is still active ..
