I believe the Right to Try measures the Govt. has taken expand what was done with compassionate use. Under compassionate use, the drug developer could, and often did, refuse to provide the drug, as an adverse reaction could stop a trial. I'm uncertain, but I believe that Right to Try has less risk to the company, and I'm not certain that they must supply the requested drug, but I believe they'll be much more likely to do it.

I can remember people wanting a trial drug who didn't qualify for a trial, or where no trial was currently enrolling patients, lobbying for help in getting the company to supply the drug. In most cases the pressure didn't work after the company denied the benefit on initial approach. I've also been told that company's could be compensated for their actual cost of providing the drug, but generally didn't request it because they didn't wish to reveal the actual cost of making it.
