If it's all about the law suit why doesnt Dan petition the courts for dismissal?

It is very easy to do. The court simply orders them to present a case or the case is dropped.

There are protections against frivolous law suits.

Either it isnt frivolous or it wouldnt matter if it was dismissed.

You say it didnt have to be a scam.
